Petition for a probe into allegations of rape against Mr.Rahul Gandhi,MP

This petition is addressed to the His Excellency, President of India, Hon’ble Prime Minister of India, Hon’ble Chief Minister of Uttar Pradesh and Hon’ble Chief Justice of India to order a probe into the serious allegations made against a public figure, and the attempts of cover-up to prevent the true facts from being revealed.

The issues are serious enough to be deliberated in all forums and not necessarily the legal forums. This has gained urgency because of a legal notice issued by Abhishek Singhvi and reported in the media.

It may be seen from representative press reports which provide prima-facie credible and verifiable information, that a serious violation of human rights seems to have occurred. The violation has been reportedly caused by someone occupying position in politics; the allegation is specific and serious that a politician has raped a girl in a gang rape. The HinduUnity.org which had originally published this report is being targeted with legal threats, violating the tenets of freedom of expression and the right to information available to every citizen.

India is a democracy and is poised to assume its rightful role in the comity of nations. It will be unfortunate if a Watergate-type cover-up is engineered to protect some people in authority while denying the rights of innocent, ordinary citizens. The reports alleging serious threats to lives of the girl and her mother and the failure of institutions in India (such as Human Rights Commission or Womens’ Rights Commission) to respond to pleas for redress do not help in positing the image of India as a functioning democracy, governed by the rule of law, with transparency in public affairs and equality of treatment to all people irrespective of gender or class � rights guaranteed under the Constitution.

The issue is grave and the plea is that 1) the justice system should take suo moto cognizance of the serious allegations made; 2) President of India should ask the Central and State Governments for an investigation into the allegations; and 3) Prime Minister should order a CBI inquiry into the allegations to clear the name of the accused and to stop the threats to innocent citizens and media persons.

If Mr. Rahul Gandhi is innocent, there should be no problem in facing up to the allegations and proving them false through the justice system. It will be unfortunate indeed for civil society, if a state of terror is unleashed with attempts of cover-up or to gag the media from reporting fairly and justly on the foibles of those engaged in public affairs.
